dc.description.abstractСтаттю присвячено комплексному дослідженню європейської моделі взаємного визнання судових рішень як стратегічного механізму подолання феномену «втрачених відповідачів» у сфері пробації в умовах воєнного стану, масової міграції населення та євроінтеграційних трансформацій України. Обґрунтовано, що територіально обмежена модель виконання вироку, закладена у національній системі кримінально виконавчого права, має структурні недоліки у випадках транскордонного переміщення суб’єктів пробації, що призводить до фактичного переривання пробаційного нагляду. Доведено, що зазначена проблема має системний характер і не зводиться до індивідуального ухилення особи від виконання покарання, а є наслідком відсутності нормативно врегульованого механізму трансферу нагляду до держави перебування. Проаналізовано доктрину екстериторіальної обмеженості судового рішення та теорію «експортної» дії як концептуальну основу формування мобільної транснаціональної моделі виконання вироку, за якої правовий статус особи зберігається незалежно від зміни територіальної юрисдикції. Розкрито зміст Рамкових рішень Ради ЄС 2008/947/JHA, 2009/829/JHA та 2008/909/JHA, що закріплюють принцип взаємного визнання та забезпечують безперервність пробаційного контролю на стадії досудового розслідування і після ухвалення вироку. Здійснено порівняльний аналіз механізмів імплементації положень, зазначених рамкових рішень у Німеччині, Австрії та Нідерландах із акцентом на ролі судового контролю, інституційної координації та орієнтації на соціальну реабілітацію засудженого. Обґрунтовано необхідність нормативного закріплення в Україні процедур трансферу виконання судових рішень, щодо суб’єктів пробації; створення єдиного координаційного механізму міжнародної взаємодії та адаптації європейських стандартів з метою забезпечення принципів верховенства права, правової визначеності та ефективного судового захисту в умовах сучасних безпекових викликів. The article is devoted to a comprehensive study of the European model of mutual recognition of judicial decisions as a strategic mechanism for overcoming the phenomenon of «lost defendants» in the field of probation under conditions of martial law, large-scale migration, and Ukraine’s European integration transformations. It is substantiated that the territorially limited model of sentence enforcement embedded in the national system of criminal-executive law reveals structural shortcomings in cases of cross-border movement of probation subjects, which leads to the actual interruption of probation supervision. It is demonstrated that this problem is systemic in nature and cannot be reduced to individual evasion of punishment, but rather results from the absence of a legally regulated mechanism for transferring supervision to the state of residence. The article analyzes the doctrine of the extraterritorial limitation of judicial decisions and the theory of the «export effect» of a judgment as a conceptual basis for the formation of a mobile transnational model of sentence enforcement, under which the legal status of a person is preserved regardless of changes in territorial jurisdiction. The content of Council Framework Decisions 2008/947/JHA, 2009/829/JHA and 2008/909/JHA is examined, as they enshrine the principle of mutual recognition and ensure the continuity of probation supervision both at the pre-trial stage and after the delivery of a judgment. A comparative analysis of implementation mechanisms in Germany, Austria, and the Netherlands is carried out, with particular emphasis on judicial control, institutional coordination, and the orientation toward the social rehabilitation of the convicted person. The necessity of legally enshrining procedures for the transfer of probation supervision in Ukraine, establishing a unified coordination mechanism for international cooperation, and adapting European standards in order to ensure the principles of the rule of law, legal certainty, and effective judicial protection in the face of contemporary security challenges is substantiated.
