Міжнародні правозахисні механізми захисту прав ув’язнених

Abstract

У статті здійснено дослідження міжнародні правозахисні механізми захисту прав ув’язнених. Зауважено, що загальне поняття «ув’язнений» включає в себе осіб, які позбавлені волі, тобто засуджених осіб які обмежені або позбавлені волі та осіб, які перебувають під вартою або до яких застосовано тимчасовий чи екстрадиційний арешт в статусі підозрюваного чи підсудного. Визначено, що правовий статус ув’язненого складається з правового статусу громадянина, спеціального правового статус засуджених, в т.ч. правового статусу особи в залежності від призначеного виду покарання, індивідуального правового становище ув’язненого, міжнародного правового статусу особи ув’язненого. Обґрунтовано, що міжнародний правовий статус особи ґрунтується на міжнародних правових стандартах прав людини визначених у міжнародних нормативно-правових актах, що гарантуються та забезпечуються міжнародними правозахисними механізмами. Підкреслено, що до міжнародних механізмів захисту прав ув’язнених відносяться: універсальні конвенційні міжнародні органи з питань захисту прав людини створені на основі міжнародних договорів і конвенцій, регіональні конвенційні міжнародні органи з питань захисту прав людини, дорадчі правозахисні органи, міжнародні судові органи, міжнародні неурядові правозахисні організації. Зауважено, що інституційна складова міжнародного механізму захисту прав ув’язнених здійснює моніторинг дотримання прав ув’язнених, розглядає індивідуальні скарги та проводить розслідування фактів порушення прав ув’язнених, розробляє стандарти та рекомендації в пенітенціарній сфері, підвищує обізнаність щодо права ув’язнених, що сприяють покращенню умов утримання, запобіганню катуванням та жорстокому поводженню, а також забезпеченню справедливого судового розгляду. The article researches international human rights mechanisms for the protection of prisoners’ rights. It is noted that the general term "prisoner" includes persons who are deprived of their liberty, that is, convicted persons who are restricted or deprived of their liberty and persons who are in custody or to whom temporary or extradition arrest has been applied in the status of a suspect or a defendant. It was determined that the legal status of a prisoner consists of the legal status of a citizen, the special legal status of convicts, including the legal status of the person depending on the type of punishment awarded, the individual legal status of the prisoner, the international legal status of the prisoner. It is substantiated that the international legal status of a person is based on international legal standards of human rights defined in international legal acts, which are guaranteed and ensured by international human rights mechanisms. It is emphasized that international mechanisms for the protection of the rights of prisoners include: universal conventional international bodies for the protection of human rights created on the basis of international treaties and conventions, regional conventional international bodies for the protection of human rights, advisory human rights bodies, international judicial bodies, international non-governmental human rights organizations. It was noted that the institutional component of the international mechanism for the protection of prisoners’ rights monitors the observance of prisoners’ rights, considers individual complaints and conducts investigations into violations of prisoners’ rights, develops standards and recommendations in the penitentiary sphere, raises awareness of the rights of prisoners, which contribute to improving detention conditions, preventing torture and ill-treatment, and ensuring fair trials.
