Напрямки реформування системи виконання покарань та приведення її до Європейських стандартів

Abstract

На підставі аналізу наукових поглядів учених і норм чинного законодавства України визначено шляхи вдосконалення системи виконання покарань, створення спеціалізованих держустанов у сфері режиму, медицини та пробації. Наведено основні проблеми вітчизняних установ виконання покарань. Запропоновано заходи з протидії корупції серед персоналу, підвищення ефективності протидії злочинності та забезпечення належного правопорядку в установах виконання покарань і слідчих ізоляторах. The organization and maintenance of the proper functioning of the penitentiary system is one of the key tasks of the modern state, an important indicator of its ability to ensure the protection of human rights as the highest social value. On the basis of the analysis of scientific views of scientists and the norms of the current legislation of Ukraine, ways of improving the system of execution of sentences, the creation of specialized state institutions in the field of regime, medicine and probation are determined. It is stressed that today the penal institutions and institutions are in a state of significant reform, which affects the management system. A swiss experience has been offered to balance the norms of the Ukrainian criminal-law system, where the work of the staff in relation to the person focuses on three areas: the health of the convict, living conditions after release, the situation with the post-release work. The main problems of domestic penitentiary institutions are presented. Many premises are used for a long time, they are not adapted to the present conditions. It has been determined that the Ministry of Justice of Ukraine has a very wide range of powers in the sphere of implementation of executive power, including those related to the implementation of the administration of penitentiary institutions and institutions, as well as the implementation of state policy in the field of execution of criminal penalties. The Ministry of Finance is charged with providing for amendments to the law "On the State Budget for 2017" separately from the total financing needs for the Ministry of Justice for 2017 for the penitentiary system, additional financing of measures for its further reformation/ Proposed measures to combat corruption among the personnel, increase the effectiveness of counteracting crime and ensure proper law and order in penitentiary institutions and investigative detention facilities.
