Правові гарантії для персоналу Державної кримінально-виконавчої служби України під час скорочення штату та чисельності працівників

Abstract

У статті досліджено нормативно-правові акти, що регулюють порядок та умови призначення, а також процедуру переміщення та звільнення осіб рядового і начальницького складу Державної кримінально-виконавчої служби України під час здійснення скорочення штату та чисельності працівників. Проведено комплексний аналіз порядку призначення осіб рядового і начальницького складу на посади під час здійснення реорганізації органів, установ виконання покарань, слідчих ізоляторів, таборів для тримання військовополонених та закладів вищої освіти зі специфічними умовами навчання Державної кримінально-виконавчої служби України. Досліджено порядок та умови звільнення персоналу Державної кримінально-виконавчої служби України у зв’язку із скороченням штату та чисельності працівників. У статті приділено увагу відмінностям процедури звільнення працівників та осіб рядового і начальницького складу як персоналу ДКВС України під час здійснення скорочення штату та чисельності працівників. Визначено основні обов’язкові етапи процедури звільнення осіб рядового та начальницького складу Державної кримінально-виконавчої служби України у зв’язку із скороченням штату та чисельності працівників. Розглянуто проблеми, що виникають при звільненні як працівників, так і осіб, які проходять службу в органах, установах виконання покарань, слідчих ізоляторах, таборах для тримання військовополонених та закладах вищої освіти Державної кримінально-виконавчої служби України за зазначеною підставою. У результаті проведеного аналізу нормативно-правових актів, що регулюють порядок та умови проходження служби в ДКВС України, з’ясовано, що правове регулювання звільнення працівників та державних службовців ДКВС України у зв’язку зі скороченням здійснюється в межах трудового законодавства, а осіб рядового та начальницького складу ДКВС України забезпечується адміністративно-правовим регулюванням проходження служби в ДКВС України, а також Кодексом законів про працю України. З метою вдосконалення процедури звільнення зі служби осіб рядового та начальницького складу Державної кримінально-виконавчої служби України запропоновано доповнення до чинного законодавства, що регулює порядок та умови проходження служби в Державній кримінально-виконавчій службі України, зокрема визначення поняття «чисельність персоналу ДКВС України». The normative and legal acts regulating the order and conditions of appointment, as well as the procedure for the transfer and dismissal of rank-and-file and command staff of the State Criminal and Executive Service of Ukraine during the reduction of staff and the number of employees are examined in the article. A comprehensive analysis of the procedure for appointing rank-and-file persons to positions during the reorganization of bodies, penal institutions, detention centers, camps for war prisoners and higher educational institutions with specific studying conditions of the State Criminal and Executive Service of Ukraine was conducted. The procedure and conditions for the dismissal of the staff of the State Criminal and Executive Service of Ukraine due to the reduction of staff and the number of employees were studied. The article pays attention to the differences in the procedure for the dismissal of employees and members of the rank-and-file and command staff as the staff of the State Criminal and Executive Service of Ukraine during the reduction of staff and the number of employees. The main mandatory stages of the procedure for the dismissal of the rank-and-file and command staff of the State Criminal and Executive Service of Ukraine in connection with the reduction of staff and the number of employees were determined. The problems arising from the dismissal of both employees and persons serving in bodies, penal institutions, detention centers, camps for war prisoners and higher educational institutions with specific studying conditions of the State Criminal and Executive Service of Ukraine on the specified grounds were considered. As a result of the analysis of normative and legal acts regulating the procedure and conditions of service in the State Criminal and Executive Service of Ukraine, it was found out that the legal regulation of the dismissal of employees and civil servants of the State Criminal and Executive Service of Ukraine in connection with redundancies, was carried out within the framework of labor legislation, and rank-and-file and command staff of the State Criminal and Executive Service of Ukraine was ensured by the administrative and legal regulation of service in the State Criminal and Executive Service of Ukraine, as well as by the Labor Code of Ukraine. In order to improve the procedure for dismissal of rank-and-file and command staff of the State Criminal and Executive Service of Ukraine, it was proposed to add the current legislation regulating the procedure and conditions of service in the State Criminal and Executive Service of Ukraine. In particular the definition of the concept of “number of personnel of the State Criminal and Executive Service of Ukraine”, was proposed.
