dc.description.abstractУ статті досліджено розвиток та функціонування системи пробації в різних країнах світу з урахуванням національних правових традицій, соціально-економічних умов і рівня інституційної зрілості. Авторами здійснено порівняльний аналіз підходів до реалізації пробаційної політики у країнах Західної Європи (зокрема, у Сполученому Королівстві Великої Британії та Північної Ірландії, Федеративній Республіці Німеччина, Королівстві Нідерланди), Скандинавських державах (Королівстві Швеція, Королівстві Норвегія, Фінляндській Республіці), Сполучених Штатах Америки, а також у країнах Центральної та Східної Європи (Чеській Республіці, Республіці Польща, Литовській Республіці). Особливу увагу приділено гуманістичним, ризикоорієнтованим та інноваційним практикам, які дозволяють знижувати рівень рецидивізму, зменшувати навантаження установ виконання покарань та забезпечувати ефективну ресоціалізацію правопорушників без ізоляції від суспільства. Розглянуто сучасні виклики у сфері пробації, серед яких: кадровий дефіцит, недофінансування, недостатня низький рівень суспільної довіри до системи пробації. На прикладі України показано процес формування національної системи пробації після ухвалення Закону України «Про пробацію» у 2015 році, з акцентом на нормативно-правове забезпечення, розвиток інституту волонтерів, міжнародну технічну допомогу та впровадження європейських стандартів. Окреслено потенційні напрямки вдосконалення, зокрема посилення взаємодії з громадськістю, розвиток електронного моніторингу та запровадження індивідуалізованих програм суб’єктів пробації. У статті також проаналізовано роль міжнародних організацій (Ради Європи, Європейського центру з питань пробації, ООН) у підтримці реформ системи пробації. Автори підкреслюють, що пробація має стати не лише альтернативою позбавлення волі, а й повноцінним інструментом гуманної та ефективної кримінальної юстиції. This article explores the development and functioning of probation systems across various countries, taking into account national legal traditions, socio-economic conditions, and the level of institutional maturity. The authors provide a comparative analysis of approaches to implementing probation policy in Western European countries (notably, the United Kingdom of Great Britain and Northern Ireland, the Federal Republic of Germany, and the Kingdom of the Netherlands), Scandinavian states (the Kingdom of Sweden, the Kingdom of Norway, and the Republic of Finland), the United States of America, as well as countries of Central and Eastern Europe (the Czech Republic, the Republic of Poland, and the Republic of Lithuania). Special attention is given to humanistic, risk-oriented, and innovative practices that contribute to reducing recidivism, decreasing the burden on penal institutions, and ensuring the effective resocialization of offenders without isolating them from society. The article examines current challenges in the probation sphere, including staff shortages, underfunding, insufficient inter-agency cooperation, and a generally low level of public trust in the probation system. Using the case of Ukraine, the authors illustrate the process of developing a national probation system following the adoption of the Law of Ukraine "On Probation" in 2015. The analysis focuses on legislative support, the development of the volunteer probation institute, international technical assistance, and the gradual implementation of European standards. The article outlines potential directions for improvement, particularly strengthening community engagement, expanding electronic monitoring practices, and introducing individualized probation programs tailored to the needs of probation clients. Additionally, the article analyzes the role of international organizations – such as the Council of Europe, the European Organisation for Probation (CEP), and the United Nations – in supporting probation system reforms. The authors emphasize that probation should be seen not only as an alternative to incarceration, but as a comprehensive and humane tool within the framework of modern criminal justice systems.
