Фінансово-правове забезпечення у системі державної кримінально-виконавчої служби України: сутність і генеза

Abstract

У статті досліджено сутність та генезу фінансово-правового забезпечення у системі Державної кримінально-виконавчої служби України. Акцентовано увагу на тому, що функціонування органів та установ, які виконують кримінальні покарання, об’єктивно пов’язане з необхідністю формування та використання публічних фінансових ресурсів, що забезпечують реалізацію покладених на них завдань і функцій. Зазначено, що ефективність діяльності Державної кримінально-виконавчої служби значною мірою залежить від належного правового регулювання процесів формування, розподілу та використання бюджетних коштів.Розглядається наукове розуміння категорії «фінансово-правове забезпечення» та обґрунтовується доцільність її застосування для характеристики правових механізмів фінансування діяль ності органів і установ виконання покарань. Визначено, що фінансово-правове забезпечення у системі Державної кримінально-виконавчої служби України доцільно розглядати як сукупність правових норм, інституційних процедур та організаційно-правових механізмів, спрямованих на формування, розподіл і використання публічних коштів з метою забезпечення функціонування органів та установ, що виконують кримінальні покарання.Обґрунтовано, що характерною особливістю фінансово-правового забезпечення у цій сфері є його комплексний характер, який проявляється у поєднанні різних видів фінансово-правових відносин, зокрема у сфері бюджетного планування, фінансування діяльності відповідних органів і установ,управління державним майном та здійснення фінансового контролю. Наголошено, що зазначений механізм виконує важливу функцію створення належних матеріальних умов для реалізації завдань системи виконання кримінальних покарань.Досліджено генезу фінансово-правового забезпечення у системі Державної кримінально-виконавчої служби України та визначено основні етапи його розвитку. Зроблено висновок, що фінансово-правове забезпечення виступає важливим інструментом реалізації державної політики у сфері виконання кримінальних покарань та забезпечення належного функціонування відповідних державних інституцій. This article examines the nature and origins of financial and legal support within the system of the State Penitentiary Service of Ukraine. It emphasizes that the functioning of the bodies and institutions responsible for enforcing criminal sentences is objectively linked to the urgency to allocate and utilize public financial resources ensuring the fulfillment of their assigned tasks and functions. It is noted that the effectiveness of the State Penitentiary Service’s activities depends to a significant extent on proper legal regulation of the processes of formation, distribution, and use of budgetary funds.The scientific understanding of the category “financial and legal support” is examined, and the expediency of its application for characterizing the legal mechanisms of financing the activities of penal enforcement bodies and institutions is substantiated. It is determined that financial and legal support within the system of the State Penitentiary Service of Ukraine should be viewed as a set of legal norms, institutional procedures, and organizational and legal mechanisms aimed at the formation, allocation, and use of public funds to ensure the functioning of bodies and institutions that enforce criminal penalties.It is argued that a distinctive feature of financial and legal support in this sphere is its comprehensive nature, which manifests itself in the combination of various types of financial and legal relations, particularly in the areas of budget planning, financing the activities of relevant bodies and institutions, management of state property, and the exercise of financial control. It is emphasized that this mechanism performs the important function of creating the necessary material conditions for the implementation of the tasks of the criminal punishment enforcement system. The genesis of financial and legal support within the system of the State Penitentiary Service of Ukraine has been examined, and the main stages of its development have been identified. It is concluded that financial and legal support serves as a significant instrument for implementing state policy in the sphere of criminal punishment enforcement and ensuring the proper functioning of relevant state institutions.
