dc.description.abstractАвтором звернено увагу, що на сьогодні у вітчизняному законодавстві залишається неврегульованим питання того, хто має відповідати за позовом про застосування заходів реагування у сфері техногенної та пожежної безпеки, якщо порушення виявлено на переданому в оренду об’єкті. На підставі аналізу чинного законодавства встановлено, що вирішальне значення для визначення характеру розподілу відповідних обов’язків та відповідальності між орендодавцем і орендарем законодавцем надається документу, яким пов’язані останні, – договору оренди; якщо ж такі положення в договорі відсутні, то презюмується, що відповідні обов’язки і відповідальність повністю покладається на власника. З теоретичного погляду дійсно виправданим є покладення саме на орендодавця-власника об’єкта першочергового обов’язку щодо забезпечення пожежної безпеки на об’єкті, адже суб’єкти, які володіють та користуються об’єктом нагляду на підставі договору оренди, можуть час від часу змінюватися, тоді як сам об’єкт перебуває у власності однієї особи – власника. Втім, видається, що в більшості випадків повністю зняти тягар відповідальності неможливо з жодної зі сторін орендних відносин. Автором проаналізовано сучасну правозастосовну практику розгляду адміністративними судами справ про застосування заходів реагування у виді зупинення роботи (експлуатації) об’єктів, переданих в оренду. Встановлено, що при розгляді справ суди нерідко розглядають договір найму (оренди) як конструкцію, що спрямована на регулювання виключно цивільно-правових прав та обов’язків сторін та їх цивільно-правову відповідальність. Водночас помічено, що на сьогоднішній день правозастосувач допускає можливість звернення до суду з таким позовом як до орендодавця, так і до орендаря, що, на нашу думку, має певне правове підґрунтя. The author draws attention to the fact that the question of who should be responsible for a claim on the application of response measures in the field of man-made and fire safety, if a violation is detected at the leased facility, remains unsettled in domestic legislation. On the basis of the analysis of the current legislation, it was established that the decisive importance for determining the nature of the distribution of the relevant duties and responsibilities between the lessor and the lessee is given by the legislator to the document that binds the latter – the lease agreement; if there are no such provisions in the contract, then it is assumed that the corresponding duties and responsibilities are fully assigned to the owner. From a theoretical point of view, it is really justified to place the primary duty on the lessor-owner of the object to ensure fire safety at the object, because the entities that own and use the object of supervision on the basis of the lease agreement may change from time to time, while the object itself is owned by one person – the owner. However, it seems that in most cases it is impossible to completely remove the burden of responsibility from any of the parties to the lease relationship. The author analyzed the modern law enforcement practice of consideration by administrative courts of cases on the application of response measures in the form of stopping work (exploitation) of leased objects. It has been established that when considering cases, the courts not infrequently consider the contract of employment (lease) as a structure aimed at regulating exclusively the civil rights and obligations of the parties and their civil liability. At the same time, it has been noticed that today the law enforcer allows the possibility of applying to the court with such a claim against both the landlord and the tenant, which, in our opinion, has a certain legal basis.
