Криміналістичний аспект дослідження особи засудженого до позбавлення волі

Abstract

Стаття присвячена проблемним питанням криміналістичного аспекту дослідження особи засудженого до покарання у виді позбавлення волі на певний строк. Проаналізовано особливості особи засудженого до позбавлення волі, що дає змогу правоохоронним органам встановити причини та умови виникнення злочинності в цілому. Класифіковано та узагальнено інформацію про особу засудженого до позбавлення волі. Зроблено акцент на аналізі зв’язку особистості злочинця із злочином, що був вчинений цією особою. The article addresses to the problematic issues of the forensic aspect of the investigation of a convicted person for a certain term. The features of a convicted person are analyzed, which allows law enforcement agencies to determine the causes and conditions of the crime occurrence in general. The information about a convicted person is classified and summarized. The problematic aspects of a term usage, which is more successful in the analysis of human criminal behavior, are revealed. The definition of terms "person", "personality", "identity of the offender", "personality of the offender". Emphasis is placed on analyzing the relationship of the offender’s personality with the crime committed by that offender. It is emphasized that the forensic study of an offender’s personality allows to identify the properties that are inherent to him as an active interaction subject with the social environment. Criminologically important to the study of offender`s identity is also that it allows to determine the causes and conditions of crime. The logic of studying the offender`s identity is increasingly pressing for the compilation and systematization of numerous data about this phenomenon, obtained by various sciences, and first of all criminology and forensics. The offender`s identity in criminology and forensics is a systemic scientific problem in the sense of involving the study, investigation of the offender’s personality, criminal behavior, the offender’s lifestyle, features of his or her social environment and relationships. Human behavior is a holistic phenomenon that cannot be divided into separate elements, such as sociological, biological, psychological, etc. This situation is due to the fact that the concept of the offender’s personality is multifaceted, with a pronounced interdisciplinary character. The vast majority of researchers emphasize that the study of the offender’s identity, traditionally referred to as criminology, is in fact an interdisciplinary and complex study.
