Реалізація цифрових та інформаційних прав людини в соціальних мережах INSTAGRAM та FACEBOOK в умовах війни

Abstract

Стаття присвячена аналізу реалізації цифрових та інформаційних прав українців в соціальних мережах Instagram та Facebook під час війни в Україні, а також розробці шляхів удосконалення механізму їх забезпечення. Підкреслюється, що в умовах сьогодення спостерігається зростання ролі інноваційних технологій, стрімка діджиталізація всіх сфер життя людини, а також формування цифрового та інформаційного суспільства, для якого першочерговим залишається сприяння розвитку демократичних засад функціонування людства. Для цього важливими є ефективне й належне забезпечення та реалізація цифрових та інформаційних прав людини. Низка українських громадян, за допомогою соціальних мереж, сприяла недопущенню дезінформації та фейкам, відсічі інформаційної війни з боку російської федерації. Їх суть полягає в репостах, зборі, документуванні та публікації цифрових медіа щодо злочинів проти людяності з боку окупантів, пересування ворожої техніки, фактах мародерства російських військових тощо. Право на публікування цифрових медіа входить до категорії цифрових прав, а свобода вираження поглядів є частиною системи інформаційних прав. Соціальні мережі Instagram та Facebook належать компанії Meta, яка активно допомагає Україні і співпрацює із Міністерством цифрової трансформації України. Але це не стало причиною перегляду правил спільноти Instagram та Facebook і українці часто стають жертвами блокування через публікування «sensitive content». Це фактично є забороною поширення інформації про війну в Україні і порушенням права на публікування цифрових медіа та свободи вираження поглядів. З огляду на зазначене, акцентовано увагу на доцільності перегляду політики Instagram та Facebook щодо українського контенту, але і вирішення на рівні компанії питання про російських користувачів, а саме ботів, які просто надсилають скарги на дописи про війну аби приховати злочини окупантів. The article is devoted to the analysis of the accomplishment of human digital and information rights Ukrainians in social networks Instagram and Facebook at the time of the war in Ukraine and the creation of ways of the development of the mechanism of the security of these rights. Authors highlighted the rise of innovation technologies` role, steep digitalization of all human life areas and the formation of digital and information society for which priority is the assistance of the development of democratic basics of functioning of society are observed in today`s conditions. For this effective and appropriate security and realization of human digital and information rights are important. Using social networks, the chain of Ukrainian citizens the denial disinformation and fakes, rebuffing the russian federation`s information war. Their essence consists in reposts, collections, documentation and publication of digital media of occupations` crimes against humanity, movement of enemy equipment, facts of russian militaries` foray etc. The right to publish digital media falls within the category of digital rights and the freedom of expression is a part of the information rights system. Social networks Instagram and Facebook belong to the company Meta. The company actively helps Ukraine and cooperates with the Ministry of digital transformation of Ukraine. But it was not a reason for revision of policy of society on Instagram and Facebook and Ukrainians often are victims of blockading because of publication of «sensitive content». In fact, it is banning the increase of information about war in Ukraine and it is a breach of the right to public digital media and the freedom of expression. In view of the above, attention is focused on the appropriateness of revision of policy of Instagram and Facebook concerning Ukrainian content and decision of the question at the level of company concerting russian users namely, bots that simply send complaints about war posts to hide occupants’ crimes.
