Процесуальні аспекти нотаріального посвідчення договору про припинення права на утримання у зв'язку з набуттям права власності на нерухоме майно

Abstract

Cтаття присвячена комплексному дослідженню процедури нотаріального посвідчення договору про припинення права на утримання у зв’язку з передачею нерухомого майна як інструменту правового регулювання відповідних сімейних правовідносин, визначення особливостей його укладення та нотаріального провадження з його посвідчення, розробка на цій основі науково обґрунтованих рекомендацій щодо вдосконалення законодавства України з цих питань. У ро боті обґрунтовано переваги погашення аліментних зобов’язань на договірних засадах порівняно з процедурою стягнення аліментів у судовому порядку. Описано проблемні питання, пов’язані з державною реєстрацією, зміною та розірванням договору про припинення права на аліменти на дитину у зв’язку з набуттям права власності на нерухоме майно. The article thesis is on the complex research of the procedure of the notary certification of an alimony contract as a tool of legal regulation of the corresponding family legal relations, definition of the special aspects of its formation and notary procedure as for its acknowledgment and based on it development of scientifically grounded recommendations as for improvement of legislation of Ukraine regarding these issues. The advantages of the maintenance obligations repayment based on contract basis and in comparison with the recovery of alimony procedure in a court of law are substantiatedin this publication. The controversial issues connected with a procedure of the notarial certification settlement, state registration, alteration and breaking a contract on termination of rights to receive alimony support on grounds of the acquisition of real estate title are described in this article. Today there is no effective system for ensuring the realization of the right of the child to stay.
