Конституційно-правові трансформації статусу та повноважень органів публічної влади в умовах воєнного стану в Україні

Abstract

У статті досліджено конституційно-правові трансформації статусу та повноважень органів публічної влади в Україні в умовах воєнного стану. Метою дослідження є комп лексний конституційно-правовий аналіз трансформацій статусу та повноважень органів публічної влади в Україні в умовах воєнного стану з метою визначення їх правової природи, меж конституційної допустимості та впливу на баланс гілок влади, а також обґрунтування критеріїв тимчасовості, пропорційності й підзвітності таких трансформа цій у контексті збереження правовладдя та демократичного конституційного ладу.Акцентовано увагу на тому, що запровадження особливого правового режиму зумов лює не лише зміну порядку реалізації публічної влади, а й модифікацію її інституційної конфігурації, перерозподіл повноважень між гілками влади, трансформацію механізмів підзвітності та контролю. Проаналізовано зміну співвідношення між законодавчою та виконавчою владою, обґрунтовано збереження представницької та контрольної ролі парламенту навіть в умовах воєнного стану.Наголошено, що в умовах демократії – навіть за режиму воєнного стану – саме парламент виступає інституційним представником суспільства та інститутом політико-правової артикуляції суспільних інтересів.Розглянуто особливості трансформації статусу Президента України та уряду як клю чових суб’єктів публічної влади, визначено ризики концентрації владних повноважень і критерії їх конституційної допустимості. Окрему увагу приділено змінам у статусі органів місцевого самоврядування та місцевих органів виконавчої влади, зокрема у зв’язку із запровадженням військових адміністрацій, а також ролі судової влади у забезпеченні судового контролю за діяльністю органів публічної влади в умовах воєнного стану.Обґрунтовано, що конституційно-правові трансформації публічної влади в екстраординарних умовах мають тимчасовий, функціонально зумовлений і пропорційний характер та не можуть розглядатися як відступ від демократичної моделі держави. Зроблено висновок, що визначальним критерієм правомірності таких трансформацій є збереження правовладдя, балансу стримувань і противаг, а також наявність ефективних механізмів повернення до звичайного конституційного режиму після припинення воєнного стану. The article deals with the constitutional and legal transformations of the status and powers of public authorities in Ukraine under martial law. The purpose of the study is a omprehensive constitutional and legal analysis of the transformations of the status and powers of public authorities in Ukraine under martial law in order to determine their legal nature, the limits of constitutional admissibility and the impact on the balance of branches of power, as well as to substantiate the criteria of temporality, proportionality and accountability of such transformations in the context of preserving the rule of law and a democratic and constitutional system.The emphasis is on the fact that the introduction of a special legal regime entails not only a change in the procedure for the implementation of public authority, but also a modification of its institutional configuration, a redistribution of powers between the branches of power, and the transformation of accountability and control mechanisms. The change in the correlation between the legislative and executive branches is analyzed, and the preservation of the representative and control role of parliament even under martial law, is grounded.It is emphasized that in a democratic environment – even under martial law – it is the parliament that acts as the institutional representative of society and the institution of political and legal articulation of public interests.The peculiarities of the transformation of the status of the President of Ukraine and the government as key subjects of public power are considered, the risks of concentration of power and the criteria of their constitutional admissibility are identified. Special attention is paid to changes in the status of local self-government authorities and local executive bodies, in particular in connection with the introduction of military administrations, as well as the role of the judiciary in ensuring judicial control over the activities of public authorities under martial law. It is substantiated that constitutional and legal transformations of public power in extraordinary conditions are temporary, functionally determined and proportional in nature and cannot be considered as a departure from the democratic model of the state. It is concluded that the determining criterion for the legitimacy of such transformations is the preservation of the rule of law, the balance of checks and balances, as well as the availability of effective mechanisms for returning to the normal constitutional regime after the end of martial law.
