Актуальні проблеми призначення та виконання покарання у виді позбавлення волі у Польщі

Abstract

У статті представлено три важливі аспекти покарання у виді позбавленняволі в Республіці Польща. Перший аспект стосується сфери правового врегулювання того покарання, що міститься в Кримінальному кодексі 1997 року. За допомогою Кодексу показано рішення, яке стосується позбавлення волі на певний строк, 25 років позбавлення волі та довічного ув’язнення. Другийаспект стосується питання призначення покарання. Обговорено принципи і правила призначення розмірів покарання у виді позбавлення волі і показано кількість вироків за це покарання. Третій аспект стосується виконання покарання у виді позбавлення волі. Він дозволив представити системи їх виконнання, а також види і типи в’язниць, які наявні в польській тюремній системі. Крім того, звернено також увагу на систему електронного контролю як способу, що дозволяє відбування цього покарання в домашніх умовах. The author of that article – K. Laskowska – described three relevant aspects of a penalty of imprisonment in Poland. The first aspect concerned the scope of the legal regulations of this penalty included in the Criminal Code from 1997. The author presented the catalogue of imprisonment penalties such as imprisonment (the period of that imprisonment is at least one month, but not more than 15 years), imprisonment for 25 years and life imprisonment. The second aspect concerned the issue of sentencing penalty of imprisonment. It allowed not only to discuss the principles and directives of passing imprisonment sentence, but also to show the number of convictions for this penalty. The third aspect concerned the execution of imprisonment. That part of article contains the characterisation of the penitentiary system, the types and the units of prisons in Poland. Moreover, there is also a description of the electronically surveillance system, as the enforcement of sentence in household conditions.
