Юридичні документи, що супроводжують контрольно-наглядову діяльність у сфері техногенної та пожежної безпеки

Abstract

Висвітлено питання юридичних документів, що супроводжують контрольно-наглядову діяльність у сфері техногенної та пожежної безпеки. Запропоновано авторські підходи до класифікації юридичних документів, пов’язаних із державним наглядом (контролем) у зазначеній сфері (залежно від етапу здійснення контрольно-наглядової діяльності, на якому створено документ; з огляду на суб’єкт, від якого походять юридичні документи; залежно від характеру інформації, котру містять документи – нормативні документи; інтерпретаційні документи нормативного або індивідуального характеру; акти застосування права (індивідуально-правові акти); акти реалізації прав та обов’язків; документи, спрямовані на фіксацію юридичних фактів). Детально проаналізовано такі юридичні документи, як наказ про проведення перевірки, припис про усунення порушень, акт перевірки. The article highlights the issue of legal documents accompanying control and supervision activities in the field of man-made and fire safety. The author’s approaches to the classification of legal documents related to state supervision (control) in the specified field are proposed. Thus, depending on the stage of control and supervision activities at which the document was created, the following types of legal documents are distinguished that accompany control and supervision activities in the field of man-made and fire safety: documents on the planning of state supervision (control) measures in the field of man-made and fire safety (annual plans for carrying out state supervision (control) measures and a plan for carrying out comprehensive state supervision (control) measures; documents drawn up in the course of and as a result of state supervision (control) measures in the field of man-made and fire safety. By the subject, from which legal documents originate, the author divided them into those created by the body of state supervision (control) in the field of man- made and fire safety, and those created by subjects in respect of which state supervision (control) in the field of man-made and fire safety is carried out. For the purposes of this study, depending on the nature of the information, legal documents are divided into the following main groups: normative documents – acts of law-making by competent bodies containing legal norms; interpretative documents of a normative or individual nature – acts of official interpretation containing explanations; аcts of application of law (individual legal acts) – acts of state power expressing the individual legal activity of competent bodies; acts of realization of rights and obligations – acts-documents expressing autonomous decisions of individuals, lawful actions; documents aimed at recording legal facts. Such legal documents as an order to conduct an inspection, an order to eliminate violations, and an inspection act were analyzed in detail.
