Abstract

таття присвячена дослідженню прогресивної системи виконання пока рання у виді позбавлення волі на певний строк у виправних колоніях. Визначено стан наукової розробки прогресивної системи виконання покарання у виді позбавлення волі на певний строк у виправних колоніях. У роботі розкрито загальну характеристику кримінально-правового інституту зміни умов відбування покарання у виді позбавлення волі. Авторами статті вказано на той факт, що умови утримання засуджених можуть змінюватися за допомогою таких способів, як умовно-дострокове звільнення від відбування покарання, звільнення в силу акту амністії, звільнення через помилування, заміна невідбутої частини покарання більш м’яким. Це, в свою чергу, є необхідними елементами прогресивної системи виконання покарання у виді позбавлення волі на певний строк у виправних колоніях. The article is devoted to the investigation of the criminal legal elements of the progressive system of execution of punishment in the form of imprisonment for a certain period in correctional colonies. The state of scientific development of the progressive system of execution of punishment in the form of imprisonment for a certain period in correctional colonies is characterized. The article substantiates the general description of the criminal law institute of changing the conditions for serving a sentence in the form of deprivation of liberty. The authors indicate that these elements are manifested in such institutions of criminal law as parole, release by virtue of an act of amnesty, release by virtue of an act of pardon, replacement of the unserved part of punishment with a softer one. When applying these elements, the severity of the crime committed, the part of the sentence served, the behavior of the convict at the time of serving the sentence are taken into account in the required order.
