КРИМІНАЛЬНО-ВИКОНАВЧІ ЗАСОБИ ЗАБЕЗПЕЧЕННЯ ЕЛЕМЕНТІВ ПРОГРЕСИВНОЇ СИСТЕМИ ВИКОНАННЯ ПОКАРАНЬ

Abstract

Стаття присвячена розгляду основних елементів прогресивної системи виконання покарань у кримінально-виконавчих установах закритого типу пе -нітенціарної системи України. У роботі проаналізовано існуючі в кримінально-виконавчих установах закритого типу елементи прогресивної системи виконання покарань, а саме: зміна умов тримання засуджених у межах установи виконання покарань та зміни умов тримання шляхом переведення до установи іншого рівня безпеки. У зв’язку з цим систематизовано вимоги чинного законадавста України з поставленої проблеми і зроблено узагальнені висновки щодо можливості засудженим зміни умов відбування покарання, головною умовою якої є поведінка останніх під час відбування покарання. The study is devoted to the examination of the main elements of the progressive system of execution of punishments in penitentiary institutions of the closed type of the penitentiary system of Ukraine. The article analyzes the elements of the progressive system of execution of punishments existing in penitentiary institutions of closed type, namely: changing the conditions of detention of convicts within the institution of execution of punishments, and changing the conditions of detention by transferring to institutions of a different level of security. In this regard, the requirements of the current legislation of Ukraine are systematized on the problem posed and general conclusions are drawn as far as possible of the convicts of changes in the conditions of serving punishment, the main condition of which is the behavior of the latter during the serving of punishment. At the same time, the authors came to the conclusion that the limitations of the established regime, in colonies of various types, differ insignificantly. For all im-portant indicators, these conditions are inherently the same.
