Правові аспекти діяльності в Україні спеціально уповноважених суб'єктів у сфері протидії корупції

Abstract

Стаття присвячена аналізу правових аспектів протидії кримінально ка раним корупційним, а також таким, що сприяють корупції, діянням в Україні. Також проаналізовано превентивні антикорупційні заходи, що мають полігалузеву специфіку. У статті на основі аналізу національного законодавства визначено найдоцільніші елементи діяльності спеціально уповноважених суб’єктів у сфері протидії корупції. The article is investigated to the analysis of some law aspects of counteraction against criminally punishable corruption acts as well as acts producing corruption in Ukraine. Preventive anticorruption measures which are used and have polybranch specificity have been analyzed in article. Also, this article analyzes the new legislative provisions to specifically authorized entities in combating corruption, including the National Agency for the Prevention of Corruption., National Anti-Corruption Bureau of Internal Affairs of Ukraine. Special attention is paid to the normative content of disclosure on the functions and powers of the prosecution in this area. It worth mention, that this research is devoted to studying the problems of corruption and overcoming it, by forming of legal principles of anticorruption policy. It was investigated legal principles that are contained in the national legislation. Was proved their place in the system of legal and administrative measures of counteraction to corruption. Moreover, the article are determined to the most appropriate elements of the specially authorized subjects in combating corruption an analysis of national legislation. This article established that the effective anticorruption policy in Ukrainecan not be effective without a coherent, planned and coordinated systematic actions of public authorities both on the national and especially on the local levels. Such аnti-corruption policy should combine three strategic directions – a strategy of public awareness, a prevention strategy and a strategy of the inevitable responsibility. The institutional administrative, political and legal, socio-economic, socio-civic and ethical and psychological mechanisms of preventing corruption in local authorities were characterized.
