Особливості виконання кримінального покарання у виді виправних робіт стосовно фізичних осіб-підприємців

Abstract

У статті проаналізовано нормативно-правову регламентацію, а також практичні аспекти виконання кримінального покарання у виді виправних робіт, призначене засудженим, які мають статус фізичних осіб-підприємців. Розкрито зміст проблемних аспектів, що виникають у практиці виконання кримінальних покарань у виді виправних робіт, призначених фізичним особам-підприємцям.

Correctional labor is a type of criminal punishment that is rarely used in domestic criminal justice. As of February 1, 2022, there were 63,739 persons on the records of the authorized probation authorities, of which 505 persons (that is, less than 1%) were assigned this type of punishment. The outlined, along with other factors, leads to the fact that aspects of the implementation of this type of criminal punishment do not often fall into the focus of attention of scholars and practitioners. However, the relevance of a full and comprehensive scientific and practical analysis of the mechanism of implementation of this type of criminal punishment is significant, because the practice of performing correctional labor is connected with the application of not only the norms of criminal law, but also labor, tax, financial, social legislation, etc. Today, there is a large number of problems associated with the imperfection of the normative and legal regulation of the relevant legal relations. One of these problems is the lack of a clear legal mechanism for the implementation of criminal punishments in the form of correctional labor assigned to convicts who has the status of natural individuals-entrepreneurs. At the same time, the number of individual entrepreneurs in Ukraine is constantly growing. As of August 7, 2022, 1,993,358 individual entrepreneurs were registered in Ukraine. The regulatory and legal regulations, as well as practical aspects of the execution of criminal punishment in the form of correctional labor, assigned to convicts who have the status of natural individuals-entrepreneurs are analyzed in the article. The essence of problematic aspects that arise in the practice of execution of criminal punishments in the form of correctional labor assigned to natural individuals-entrepreneurs is revealed.
