Особливості управління в органах та установах виконання покарань в Україні

Abstract

Статтю присвячено питанням управління в системі Державної кримінально-виконавчої служби України в процесі подальшого реформування (розвитку) пенітенціарної системи України для беззаперечного дотримання прав людини та громадянина й гуманізації кримінального-виконавчого механізму, встановлення відповідності між завданнями та функціями таких органів, структурою та їхньою чисельністю, а також фінансовим забезпеченням. У межах цієї статті досліджено особливості управління в органах та установах виконання покарань в Україні. Зазначено, що процес управління в органах та установах виконання покарань вимагає високої кваліфікації та розуміння особливостей, пов’язаних зі специфікою кримінально-виконавчої сфери. У контексті проведеного дослідження встановлено, що управління в органах та установах виконання покарань – це складний процес, який узагальнює комплекс процедур, кожна з яких наділена власним специфічним операційним призначенням, а також зумовлена особливістю визначення загальної мети та конкретних завдань, формулюванням конкретних управлінських рішень тощо. Доведено, що функції управління здійснюються за допомогою різних методів та технологічних операцій, які виконуються послідовно; їх сукупність утворює процес управління, який має циклічний характер. Автору вдалося підкреслити специфіку управління, що здійснюється всередині системи виконання покарань, за якого об’єктами управління є працівники, служби, підрозділи, органи, а суб’єктами – керівники та управляючі апарати, які діють на відповідних рівнях і являють собою у своїй сукупності управляючу підсистему всієї системи цих органів загалом і кожного окремо. У процесі теоретико-практичного аналізу діяльності системи управління Державною кримінально-виконавчою службою України автор доходить висновку, що управління системою виконання покарань є одним зі специфічних видів об’єктів управління з боку держави. Сам же технологічний процес управління в органах та установах виконання покарань автор визначає як процес, який складається з традиційних управлінських циклів та процедур за умови врахування специфічної сфери – виконання покарань. The article is devoted to issues of management in the system of the State Criminal and Executive Service of Ukraine in the process of further reformation (development) of the penitentiary system of Ukraine for the unconditional adherence to human and civil rights and the humanization of the criminal-executive mechanism, establishing the correspondence between the tasks and functions of such bodies, structure and their number, as well as financial security. Within the framework of this article, the peculiarities of management in penal organs and penal institutions in Ukraine are investigated. It is noted that the process of management in penitentiary organsns and institutions requires high qualification and understanding of the specifics related to the specifics of the criminalexecutive sphere. In the context of the study, it was found that management in penitentiary organsns and institutions is a complex process that summarizes a set of procedures, each of which has its own specific operational purpose, and is due to the peculiarity of defining a common goal and specific tasks, the formulation of specific managerial decisions, and so on. It is proved that management functions are carried out using various methods and technological operations, which are performed sequentially; their totality forms a process of management, which has a cyclic nature. The author managed to emphasize the specifics of management that is carried out within the system of execution of penalties, in which the objects of management are employees, services, units, bodies, and actors – managers and control apparatus, acting on the appropriate levels and represent in their totality the manager subsystem of the entire system of these bodies in general and each separately. In the process of theoretical and practical analysis of the management system of the State Criminal Execution Service of Ukraine, the author concludes that the management of the system of penalties is one of the specific types of state control objects. The author describes the technological process of management in penal organs and institutions as a process that consists of traditional management cycles and procedures, provided that they take into account a specific sphere of execution of sentences.
