Управлінські рішення в установах виконання покарань

Abstract

Стаття присвячена дослідженню проблематики та особливостей прийняття управ лінських рішень в установах виконання покарань. До основних завдань, які були постав лені автором, можна віднести такі: визначення змісту та сутності поняття «управлінське рішення в установах виконання покарань»; визначення особливостей процесу форму вання управлінського рішення в установах виконання покарань; визначення особливостей під час прийняття управлінських рішень в установах виконання покарань. Дослі джено поняття «управлінське рішення» та сучасні підходи до його визначення у сфері виконання покарань. З’ясовано, що, на відміну від керівника (начальника) установи виконання покарань, інші посадові особи можуть приймати рішення виключно щодо тієї функціональної сфери, яка визначена сферою їхньої відповідальності. На основі Положення «Про організацію соціально-виховної та психологічної роботи із засудженими» проаналізовані повноваження начальника відділення соціально-психологічної служби, що обумовлюють прийняття рішень, які пов’язані з діяльністю відділення, та ініціюють звернення несубординаційного характеру до інших підрозділів. Виокремлені та охарактеризовані ознаки управлінських рішень в установах виконання покарань. Автор визначає управлінське рішення в установах виконання покарань як керівний вплив, що спрямовується на суб’єктів реалізації (якими здебільшого є персонал відповідних функціональних підрозділів, в окремих випадках – засуджені особи), має спрямувальний характер щодо вирішення конкретних завдань або проблем, які виникають під час організації процедур виконання кримінальних покарань, і формалі зується в управлінських актах керівників установ виконання покарань. Запропоновано розробити Методичні рекомендації організації управлінської діяльності в установах виконання покарань, де одним із розділів передбачити питання розробки, прийняття та реалізації управлінських рішень керівниками підрозділів різного рівня. The article is devoted to the issue of making managerial decisions in penal institutions and its peculiarities. The main tasks that were set are the following: to define the content and essence of the concept of “managerial decision in penal institutions”; to determine the peculiarities of the process of making managerial decision in penal institutions; to identify the peculiarities in the process of making managerial decisions in penal institutions and the significance of managerial decision. The concept of the term “managerial decision” in general and the modern approaches to view the concept of “managerial decision” in the field of execution of punishments are studied. It is found out that, unlike a head (manager) of a penal institution, other officials may make decisions only in relation to the functional field defined as the field of their responsibility. Based on the Regulation “On the Organization of Socio-Educational and Psychological Work with Convicts”, the powers of the head of the department of social and psychological services, which determine the decisions related to the activities of the department and initiate nonsubordinate appeals to other units are analyzed.The peculiarities of managerial decisions in penal institutions are identified and characterized. The author’s definition of the managerial decision in penal institutions as a guiding influence, which is directed at the subjects of implementation (which are mostly the staff of the relevant functional units, in some cases – convicts), has a guiding nature to address specific tasks or problems that arise while organizing the procedures of execution of criminal punishments, and is formalized in administrative acts of heads of penal institutions. Methodical recommendations of organizing administrative activity in penal institutions where one of the sections should be devoted to the issue of developing, acceptance and exercising of administrative decisions by the heads of the divisions at various levels are offered to be developed.
