Організаційно-управлінські заходи запобігання корупційним правопорушенням у кримінально-виконавчій системі України

Abstract

У статті досліджено організаційно-управлінські заходи запобігання корупційним правопорушенням у кримінально-виконавчій системі України в умовах воєнного стану. Обґрунтовано, що специфіка діяльності цієї системи, зумовлена її відносною закритістю та асиметрією правового статусу учасників кримінально-виконавчих відносин, сприяє латентності корупційних проявів. Проаналізовано наукові підходи до розуміння запобігання корупції як комплексного попереджувального процесу. На підставі результатів анонімного опитування персоналу установ виконання покарань і слідчих ізоляторів та аналізу офіційної статистики встановлено значний розрив між реальною поширеністю корупційних проявів і кількістю виявлених фактів. Зроблено висновок про необхідність удосконалення організаційно-управлінських антикорупційних заходів у діяльності кримінально-виконавчої системи України. The article examines organizational and managerial measures for preventing corruption-related offenses in the penitentiary system of Ukraine under martial law. It is substantiated that corrupt practices in the activities of the penitentiary system pose an increased social danger, as they encroach not only on legality and the principle of the rule of law, but also on the protection of the rights and freedoms of persons serving sentences. Emphasis is placed on the fact that the specific nature of the functioning of this state institution, conditioned by its relative closed nature and the asymmetry of the legal status of participants in penitentiary relations, creates additional prerequisites for the latency of corruption-related offenses. The scientific approaches of Ukrainian scholars to understanding the prevention of corruption-related crime as a complex and systemic process, in which preventive measures are given priority, are analyzed. The role of organizational and managerial measures is substantiated as an important element of anti-corruption policy aimed at eliminating and neutralizing the determinants of corruption. Based on the results of an anonymous survey of 5,930 employees of penitentiary institutions and pre-trial detention centers, as well as an analysis of official statistics on criminal offenses provided for in Article 368 of the Criminal Code of Ukraine, a significant gap between the actual prevalence of corrupt practices and the number of detected and officially recorded cases has been identified, indicating a high level of latency. It is concluded that there are shortcomings in the system of organizational and managerial measures for preventing corruption in the penitentiary system of Ukraine, which substantiates the need for their further improvement in light of contemporary challenges.
