Інформаційна безпека та та захист персональних даних у цифровому освітньому середовищі ДКВС України

Abstract

У статті розкрито проблематику забезпечення інформаційної безпеки та захисту персональних даних під час професійної підготовки персоналу Державної кримінально-виконавчої служби (ДКВС) України. В умовах стрімкої цифровізації освітнього простору впровадження інтелектуальних систем, аналітичних платформ та алгоритмів штучного інтелекту вимагає надійного нормативного підґрунтя для збереження конфіденційності й цілісності інформації. Головною метою роботи є комплексний аналіз чинного національного законодавства та міжнародних стандартів для формування дієвих механізмів захисту даних у цифрових системах ДКВС. Досліджено базові правові акти, зокрема закони України «Про захист персональних даних», «Про Національну програму інформатизації», а також законодавство у сфері електронних довірчих послуг та кібербезпеки. Акцентовано на необхідності розроблення внутрішніх політик відомства, які б чітко регламентували обробку відомостей про слухачів і викладачів із суворим дотриманням принципів пропорційності та мінімізації. Окремо виділено питання етичності та прозорості алгоритмічних рішень під час використання ШІ-модулів. Обґрунтовано потребу імплементації міжнародних документів, насамперед Конвенції Ради Європи про автоматизовану обробку персональних даних та Європейських пенітенціарних правил. Доведено, що адаптація правового забезпечення до європейських вимог та інтеграція Європейської рамки кваліфікацій (EQF) безпосередньо сприятимуть створенню безпечного цифрового середовища. Підсумовано, що модернізація підготовки кадрів ДКВС потребує комплексного підходу, де сучасні технічні заходи кіберзахисту органічно поєднуються з адміністративно-правовими гарантіями приватності, що цілком відповідає євроінтеграційному курсу держави. The article examines the issues surrounding the provision of information security and the protection of personal data in the course of professional training of personnel of the State Criminal Executive Service of Ukraine (SCES). In the context of the rapid digitalisation of the educational environment, the implementation of intelligent systems, analytical platforms, and artificial intelligence algorithms necessitates a robust regulatory framework to ensure the confidentiality and integrity of information.The principal aim of this study is to conduct a comprehensive analysis of the current national legislation and international standards in order to develop effective mechanisms for data protection within the digital systems of the SCES. The research explores key legislative acts, in particular the Laws of Ukraine “On Personal Data Protection”, “On the National Informatization Programme”, as well as legislation in the field of electronic trust services and cybersecurity.Particular emphasis is placed on the necessity of developing internal departmental policies that would clearly regulate the processing of information concerning trainees and teaching staff, with strict adherence to the principles of proportionality and data minimisation. Specific attenton is also given to the issues of ethical compliance and transparency of algorithmic decision-making in the use of AI modules.The study substantiates the need to implement international instruments, primarily the Council of Europe Convention on the Automatic Processing of Personal Data and the European Prison Rules. It is demonstrated that the adaptation of legal regulation to European standards, together with the integration of the European Qualifications Framework (EQF), will directly contribute to the establishment of a secure digital environment. It is concluded that the modernisation of personnel training within the SCES requires a comprehensive approach in which contemporary technical cybersecurity measures are effectively combined with administrative and legal guarantees of privacy, fully in line with the State’s European integration course.
