Діяльність органів пробації в країнах Західної Європи: досвід країн Скандинавії як приклад для наслідування

Abstract

У статті висвітлено важливість становлення служби пробації в Україні, оскільки розвиток цієї інституції наближає вітчизняне правове поле до «європейських стандартів». На сьогодні кримінально-правова та кримінальновиконавча політика України спрямована на економію репресії та широке застосування (там, де це можливо і доцільно) покарань, не пов’язаних із позбавленням волі, враховуючи те, що наслідки ув’язнення є негативними як для особистості засудженого, так і для самого суспільства. Досліджено, що у країнах Західної Європи, в тому числі країнах Скандинавського півострова, органи нагляду та пробації організовані в межах Міністерства юстиції. Офіцери пробації є державними службовцями. З метою встановлення контактів їм можуть допомагати добровільні наглядачі, особливо актуальним це є для малозаселених територій. Діяльність добровільних наглядачів координує служба пробації. This article highlights the importance of the establishment of a probation service in Ukraine. Offences committed by citizens who, as a part of society, often provoked by certain circumstances. Persons who have not committed serious crimes and realized his guilt should not be isolated, and have the opportunity diligent work to correct their mistakes, on the other hand the environment for the offenders is a responsibility for them. An important factor in the probation service is an element of social rehabilitation of prisoners and reduce the economic burden on society. Probation of Ukraine becoming closer to «European standards». Criminal policy in Ukraine is aimed at saving repression and widespread use (where feasible and appropriate) of punishments not related to imprisonment, given that the consequences of imprisonment are negative both for the person of the convict and for himself of society. It is in this way that the majority of foreign countries are in a country where alternative punishment execution is made by a specialized civil service, which is located outside the police and prison, a probation service. Thus, summarizing our analysis of foreign experience, it is worth noting that in the countries of Western Europe, including the Scandinavian countries, supervisory and probation bodies are organizing within the Ministry of Justice. Probation officers are civil servants. But volunters can help them to establish contacts, especially in less populated areas. The activity of voluntary supervisors is managing by the probation service. That is why the Scandinavian vector of the development of the probation bodies system is the most expedient example of imitation of Ukraine.
