Інформаційне право України як комплексна та динамічна галузь правового регулювання в умовах цифрової трансформації

Abstract

У статті здійснено комплексний науково-правовий аналіз інформаційного права України як міжгалузевої та динамічної правової системи. Досліджено його конституційні засади, структурну побудову, принципи та предмет правового регулювання. Особливу увагу приділено еволюції законодавства про інформацію, зокрема реформі 2011 року, інституту захисту персональних даних і впливу цифровізації на розвиток інформаційно-правових норм. Обґрунтовано значення інформаційного права для забезпечення прав людини, інформаційної безпеки та демократичного врядування. The article provides a comprehensive scientific and legal analysis of information law of Ukraine as an interdisciplinary and dynamically developing branch of the national legal system. The study examines the constitutional foundations of information law, its subject matter, principles, internal structure, and methods of legal regulation in the field of creation, collection, processing, storage, dissemination, and protection of information. Particular attention is paid to the evolution of Ukrainian information legislation, with an emphasis on the 2011 reform of the Law of Ukraine “On Information,” which marked the transition from a unified regulatory model to a specialized and structurally differentiated system of legal acts. The paper substantiates the role of information law in ensuring fundamental human information rights and freedoms, including the right of access to information, freedom of expression, and the protection of privacy and personal data. The author analyses the institute of personal data protection in the context of digitalisation of public administration, expansion of electronic registers, and approximation of Ukrainian legislation to European standards, particularly the principles of the GDPR. The impact of rapid technological development, cybersecurity challenges, and digital transformation on the content and dynamics of information and legal norms is also highlighted. It is argued that information law in Ukraine performs not only a regulatory but also a protective and system-forming function, contributing to democratic governance, transparency of public authorities, and national information security. The article concludes that information law constitutes one of the key legal platforms for modernising the state in the conditions of the information society and European integration.
