Об’єкт та предмет фінансових правовідносин щодо обігу цінних паперів

Abstract

У статті зазначені основний підхід у визначенні структури та об’єкта правовідносин разом з його класифікацією. Досліджені об’єкт і предмет фінансових правовідносин, визначено їх співвідношення. Зазначено місце цінних паперів у фінансово-правовому регулюванні. Визначено види цінних паперів, що беруть участь у фінансових правовідносинах. Зазначено інститут фінансового права, у якому цінні папери використовуються. Схарактеризовано основні об’єкти правовідносин щодо державного боргу та їх співвідношення з цінними паперами. Обґрунтовано підхід використання цінних паперів як предмета правовідносин щодо державного боргу. The article indicates the main approach in determining the structure and object of legal relations together with its classification. The object and subject of financial legal relations are studied, their correlation is determined. The place of securities in financial and legal regulation is indicated. The types of securities that participate in financial legal relations are determined. The institution of financial law in which securities are used is indicated. The main objects of legal relations regarding the state debt and their correlation with securities are characterized. The approach of using securities as the subject of legal relations regarding the state debt is substantiated. Currently, Ukraine exists in martial law and is faced with the challenge of stabilizing the economy and preparing the ground for investment from third countries. In view of the above, both the degree of development of the regulatory framework in the field of investment and budgetary activities and the availability of approaches developed by the scientific community to determine the location of securities are important. All this is especially important in the context of European integration, since securities are an effective way to attract funds to the state and local budgets. The financial and legal nature of securities has received relatively little attention, as well as financial and legal relations regarding the circulation of securities. The problem of determining the object of financial legal relations is also urgent to solve, since it is a fundamental brick from which the entire system of financial law is built. Scientists have paid much attention to this issue, but there are still some controversial points related to this range of issues. One of these, for example, is the use of the subject along with the object of legal relations. Not all financial legal relations require the presence of an object, but as determined in the article, at least one institution of financial law effectively uses it.
