Правові засади та перспективи використання штучного інтелекту у системі підготовки персоналу ДКВС України

Abstract

Досліджуються правові, організаційні та етичні аспекти впровадження технологій ШІ у систему вищої освіти та професійної підготовки персоналу ДКВС України. Проаналізовано потенціал ШІ як інструменту цифрової трансформації освітнього процесу, персоналізації навчання та автоматизації управлінських рішень. Особливу увагу приділено ризикам безконтрольного використання генеративних систем, питанням академічної доброчесності, захисту персональних даних і необхідності формування належного нормативно-правового забезпечення. The article examines the legal, organizational, and ethical aspects of implementing artificial intelligence technologies in higher education and the professional training system of the State Criminal-Executive Service of Ukraine. Artificial intelligence is analyzed as a key driver of digital transformation, capable of enhancing educational quality through personalization, automation of administrative processes, and data-driven decision-making. The study emphasizes that AI should function as an intellectual support tool rather than a substitute for human cognitive activity, particularly in legal and educational environments. Special attention is paid to legal risks associated with the uncontrolled use of generative AI systems, including threats to academic integrity, distortion of educational outcomes, algorithmic opacity, and violations of personal data protection. The article highlights the importance of developing a comprehensive regulatory framework that ensures transparency, accountability, nondiscrimination, and compliance with fundamental human rights. International approaches and UNESCO AI competency frameworks are considered as reference points for shaping national legal policy. The research substantiates that the integration of AI into the professional training of penitentiary personnel requires a balanced approach that combines technological innovation with legal safeguards and ethical standards. The formation of information and legal support mechanisms for AI implementation is identified as a strategic prerequisite for ensuring the legitimacy, security, and effectiveness of digital transformation processes in the penitentiary education system.
