Загальна характеристика організованої злочинності у сфері незаконного обігу наркотичних засобів, їх аналогів або прекурсорів

Abstract

У статті автор розглядає загальну характеристику організованої злочинності у сфері незаконного обігу наркотичних засобів, психотропних речовин, їх аналогів або прекурсорів. Виокремлено три історичні періоди становлення і розвитку організованої злочинності у сфері незаконного обігу наркотичних засобів, їх аналогів або прекурсорів. I період (1991–2001 рр.) характеризується розбудовою нової Української держави, ухваленням національних законів щодо запобігання організованій злочинності у сфері незаконного обігу наркотичних засобів, їх аналогів або прекурсорів як суспільно небезпечному утворенню. II період (2001–2022 рр.) – створення нових підрозділів у правоохоронних органах та вдосконалення запобігання організованій злочинності у сфері незаконного обігу наркотичних засобів, їх аналогів або прекурсорів. III період (2022–дотепер) – запобігання організованій злочинності у сфері незаконного обігу наркотичних засобів, їх аналогів або прекурсорів в умовах правового режиму воєнного стану. У статті перераховано актуальні проблеми, що стосуються організованої злочинності у сфері незаконного обігу наркотичних засобів, психотропних речовин, їх аналогів або прекурсорів, та показано особливо вразливі групи осіб, які схильні до участі в організованих злочинних групах з метою вчинення кримінальних правопорушень у сфері незаконного обігу наркотичних засобів, психотропних речовин, їх аналогів або прекурсорів. The article addresses to the problem of organized crime in the sphere of illicit trafficking of drug products, psychotropic substances, their analogues or precursors. It is proved that this problem is a sad reality of modern life in many countries of the world. Unfortunately, Ukraine, as a sovereign, independent, democratic, social and legal state, is no exception. The organized criminality is noted to be in the field of illicit trafficking of drug products, psychotropic substances, their analogues or precursors is an appropriately cohesive criminal environment for conducting a criminal illegal lifestyle in conditions of deep secrecy for a long time with the aim of gaining control and training in the field of illicit trafficking of drug products, psychotropic substances, their analogues or precursors. Of course, organized crime in the field of illicit trafficking of drug products, psychotropic substances, their analogues or precursors is an extremely negative independent phenomenon that arose in the process of development of crime itself. It is nothing more than the merger of various types of criminal offenses committed by organized criminal groups into a single criminal activity. Based on the conditions of the legal regime of martial law, the requirements of society in Ukraine to reform the state approach to preventing organized crime in the field of illicit trafficking of drug products, psychotropic substances, their analogues or precursors, external and internal factors show the unsatisfactory state of law enforcement in this area. Moreover, the Russian-Ukrainian war has had a significant impact on the prevention of organized criminality in the field of illicit trafficking of drug products, psychotropic substances, their analogues or precursors, both in the country and abroad. The above-mentioned shows that organized crime in the field of illicit trafficking of drug products, psychotropic substances, their analogues or precursors has long-term social and medical consequences. Therefore, in order to achieve the goal of the subject matter of the study “Organized criminality in the field of illicit trafficking of drug products, their analogues or precursors: criminological characteristics and prevention”, we have identified the following tasks that can thoroughly study this problem and develop scientific recommendations and legislative proposals for its criminological characteristics and prevention. The author concludes that organized criminality in the field of illicit trafficking of drug products, their analogues or precursors is: 1) a complex system of contradictions of political, moral, psychological, economic, organizational, managerial, legal and ideological nature in the system of legislative, executive and judicial branches of power; 2) a real threat to democracy, the rule of law, national and international security and democratic development of the state, which poses a direct threat to the national security of the country; 3) a special impact on all aspects of public life: economy, politics, governance, social and legal spheres, public consciousness, and international relations.
